CLDH press release: Refugees should be welcome in Lebanon
Beirut, June 20th 2017 – On the occasion of the World Refugee Day 2017, the Lebanese Center for Human Rights (CLDH) wishes to express its solidarity with all the refugees present on the Lebanese territory, whether they are Palestinian, Syrian, Iraqi, Somalian, Sudanese or from any other nationality.
According to the Geneva Convention relating to the Status of Refugee, is considered as refugee “a person who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.”
Although Lebanon is not a Party to the Geneva Convention, it is still bound by its international commitments such as the International Covenant on Civil and Political Rights and the Convention Against Torture (particularly article 3) that it both ratified.
Nothing can justify the hate and xenophobic discourse of some political officials against refugees, nor the survival conditions imposed upon them in Lebanon (expensive sub-standard and unsafe housing; women, child and workers’ abuse; refusal to grant a legal status; arbitrary arrests; torture, rape and beatings).
CLDH also deplores the limited access to healthcare, food security and education refugees are facing, and which is directly attributable to both the international community and the Lebanese government whose efforts are insufficient to prevent corruption and promote the universality and safeguard of basic human rights.
Given the huge resources that the international community allocates on military aid in the Middle East, CLDH considers it can well afford to ensure the protection of all the vulnerable refugees with a well-functioning system of resettlement to third safe countries. CLDH yet regrets the lack of will and engagement to identify vulnerable persons, and their resettlement – in dribs and drabs – in safe countries despite the urgent conditions of many of them.
Lebanon, by its international commitments, has to focus all its efforts in ensuring a decent hosting of all refugees seeking temporary protection. Better hosting conditions can only be achieved with political will, which is currently lacking.
Beyrouth, le 20 juin 2017 - A l’occasion de la Journée Mondiale des Réfugiés, le Centre Libanais des Droits Humains souhaite exprimer sa solidarité avec l’ensemble des réfugiés présents sur le territoire libanais, qu’ils soient Palestiniens, Syriens, Irakiens, Somaliens, Soudanais ou d’autres nationalités.
Selon la Convention de Genève sur le statut des réfugiés, « le terme « réfugié » s'appliquera à toute personne qui craignant avec raison d'être persécutée du fait de sa race, de sa religion, de sa nationalité, de son appartenance à un certain groupe social ou de ses opinions politiques, se trouve hors du pays dont elle a la nationalité et qui ne peut ou, du fait de cette crainte, ne veut se réclamer de la protection de ce pays ; ou qui, si elle n'a pas de nationalité et se trouve hors du pays dans lequel elle avait sa résidence habituelle, ne peut ou, en raison de ladite crainte, ne veut y retourner ».
Même si le Liban n’est pas partie à cette convention, le pays n’en est pas moins tenu par ses engagements internationaux tels que le Pacte International relatif aux droits civils et politiques et la Convention contre la Torture (notamment l’article 3 de la Convention) qu’il a ratifiés.
Or, rien ne saurait justifier les discours xénophobes de certains responsables politiques à l’égard des réfugiés, ni les conditions de survie qui leur sont infligées au Liban (logements insalubres loués à des prix excessifs, exploitation des femmes, des enfants et des travailleurs, refus de leur accorder des documents de résidence, arrestations arbitraires, torture et passage à tabac…).
De même, le CLDH déplore le manque d’accès à la santé, à l’alimentation et à l’éducation des réfugiés, imputable tant à la communauté internationale qu’au gouvernement libanais qui font des efforts très insuffisants pour prévenir la corruption et promouvoir l’universalité des droits humains fondamentaux.
Prenant en considération les budgets militaires astronomiques de la communauté internationale investis au Moyen Orient, le CLDH considère que celle-ci a largement les moyens d’offrir une protection à l’ensemble des réfugiés vulnérables par un système performant de réinstallation dans des pays tiers. Au lieu de cela nous déplorons le manque de mobilisation dans l’identification des personnes vulnérables et leur réinstallation au compte-gouttes dans des pays sûrs malgré l’urgence de nombreuses situations.
Le Liban, de par ses engagements internationaux, doit mettre tout en place pour assurer un accueil décent pour l’ensemble des réfugiés qui cherchent une protection temporaire. Ces conditions d’accueil ne peuvent être mises en place qu’avec une volonté politique qui pour l’instant n’existe pas.
من أجل ظروف مضيافة أكثر للاجئين في لبنان
يجب الترحيب باللاجئين في لبنان.
بيروت، 20 حزيران 2017 – في مناسبة يوم اللاجئ العالمي 2017، يريد المركز اللبناني لحقوق الإنسان التعبير عن تضامنه مع كل اللاجئين الموجودين على الأراضي اللبنانية، سواء كانوا فلسطينيين، سوريين، عراقيين، صوماليين، سودانيين، أو من أية جنسية أخرى.
تنص اتفاقية جنيف الخاصة بوضع اللاجئين أن اللاجئ هو كل شخص يوجد خارج بلد جنسيته أو بلد إقامته المعتادة، بسبب خوف له ما يبرره من التعرض للاضطهاد بسبب العرق، أو الدين، أو القومية، أو الانتماء إلى طائفة اجتماعية معينة، أو إلى رأي سياسي، ولا يستطيع بسبب ذلك الخوف أو لا يريد أن يبقى بحماية ذلك البلد أو العودة إليه خشية التعرض للاضطهاد.
رغم أنّ لبنان لم يوقع على هذه الاتفاقية، الا أنه مقيد بالالتزامات الدولية التي صدّق عليها مثل العهد الدولي الخاص بالحقوق المدنية والسياسية واتفاقية مناهضة التعذيب (خاصة المادة 3).
فلا يمكن تبرير الحقد وكراهية الأجانب التي يبديها بعض السياسيين ضد اللاجئين، ولا يمكن تبرير الظروف المعيشية المفروضة عليهم في لبنان (المعيشة الباهظة الثمن وغير الامنة؛ إساءة معاملة النساء، الأطفال والعمال؛ رفض إعطائهم وضع قانوني؛ الاعتقال التعسفي؛ التعذيب؛ الاغتصاب؛ والضرب).
يستنكر المركز اللبناني لحقوق الانسان ايضًا الوصول المحدود إلى الرعاية الصحية، الغذاء، والتعليم، الذي يعاني منه اللاجئين، والتي ينتج مباشرةً من الجهود الدولية واللبنانية غير الكافية للحد من الفساد ونشر ثقافة احترام وحماية الحقوق الانسانية الاساسية.
نظراً الى الموارد الضخمة التي ينفقها المجتمع الدولي على المساعدات العسكرية في الشرق الاوسط، يعتبر المركز اللبناني لحقوق الانسان انه بإمكان هذا المجتمع الدولي تحمل نفقة حماية كل اللاجئين المعرضين للخطر والمستضعفين من خلال نظام جيد الأداء يوفر اعادة توطين الى بلاد ثالثة امنة. لذلك يتأسف المركز اللبناني لحقوق الانسان من نقص الارادة والالتزام الذي يمكّن تحديد اللاجئين الضعفاء واعادة توطينهم – خطوة خطوة – الى بلاد امنة رغم ان للكثير منهم اوضاع طارئة.
على لبنان، ومن أجل احترام التزاماته الدولية، تركيز جهوده على توفير استقبال لائق لكل اللاجئين الذين يسعون لحماية مؤقتة. لا يمكن توفير ظروف مضيافة أفضل الا بوجود الارادة السياسية، التي مازالت غائبة.
